The state has made an application to have the matter of Former Minister of ICT Supa Mandiwanzira postponed for at least one and a half months in order to allow High Court proceedings to take centre stage, TechnoMag can confirm.
According to the state, it is not possible to proceed with the matter until the High Court application is dispensed with. The defence team of Advocate Thembinkosi Magwaliba instructed by Mr Selby Hwacha of Dube Manikai and Hwacha, consented to the request, and the matter will now be heard on July 16 2019.
The Former Minister of ICT is facing a charge of having appointed his Ministerial Personal Assistant Tawanda Chinembiri onto the Potraz board, when he was not an employee of the government.
However in earlier court proceedings the defense has rubbished the allegations saying Chinembiri was in actual fact an employee of the public service commission since March 2015 while his appointment to the board was in February 2016. The defense has gone as far as saying all this information was contained in the state papers.
“In the interest of justice the state must do the honorable thing and withdrawal the charges as there is no case against our client,” the defence has said.
Proceeding with the matter, they have argued, is an abuse of authority and unnecessary persecution of the Former Minister.
